ZAMBOANGA SIBUGAY โ The Department of Labor and Employment (DOLE) in Zamboanga Sibugay reminded private sector employers to strictly follow labor standards, particularly the mandatory release of the 13th Month Pay to rank-and-file workers on or before December 24.
Provincial Director Elamsalih Ungad reiterated that the 13th Month Pay is a statutory obligation under Presidential Decree No. 851, and all eligible workers who rendered at least one month of service within the year must receive the benefit.
โThe law is clearโthis benefit must be released not later than December 24,โ Ungad said, stressing that no exemption or deferment will be allowed under the decree and its implementing rules.
To support monitoring efforts, DOLE urged establishments to submit their compliance report through the DOLE Online Compliance Portal at reports.dole.gov.ph.
Ungad noted that timely payment is especially crucial during the Christmas season, as the additional income provides vital support for workers and their families.
Penalties for non-compliance
Employers who fail to release the mandated 13th Month Pay may face administrative fines, labor inspection assessments, and civil liabilities covering unpaid benefits plus interest. Repeated or willful violations may also result in criminal charges under the Labor Code.
DOLE encouraged workers in the province to report cases of delay, underpayment, or non-release of their 13th Month Pay.
The agency assured the workers that the local office remains ready to assist.
