ICC Rejects Duterteโ€™s Bid for Interim Release, Citing Flight Risk and Threat to Proceedings

MANILA, Philippines (DSC) โ€” The International Criminal Court (ICC) has denied former Philippine President Rodrigo Duterteโ€™s request for interim release, citing concerns over flight risk, obstruction of justice, and the potential for continued criminal activity.

In a 23-page ruling issued Friday, the ICCโ€™s Pre-Trial Chamber I stated that Duterteโ€™s detention remains necessary under the Rome Statute. The court emphasized three key reasons: ensuring his appearance at trial, preventing interference with the investigation, and stopping the possible commission of further crimes.

โ€œThe Chamber is of the view that, contrary to the Defenseโ€™s assertion, there exists a risk that, should he be released, Mr. Duterte will continue committing the crimes charged against him,โ€ the judges wrote in their decision.

The ruling also referenced Duterteโ€™s public rejection of the ICCโ€™s authority, including statements describing his arrest as โ€œpure and simple kidnapping.โ€ Judges noted that remarks from Duterteโ€™s family, including Vice President Sara Duterte, reinforced concerns about non-compliance with court proceedings.

Duterte remains in custody at the ICC Detention Center in The Hague. His defense team had argued for release based on his age and unspecified medical concerns, but the court found the claims insufficient to override the risks posed by his release.

The former president faces charges related to alleged crimes against humanity stemming from his administrationโ€™s controversial war on drugs, which left thousands dead. Human rights groups and victimsโ€™ families have welcomed the ICCโ€™s decision, viewing it as a step toward accountability.

The case continues to draw international attention as the ICC moves forward with pre-trial proceedings.
